By accessing or using ShiftAI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ShiftAI is an AI-powered staff scheduling platform designed for cafes, restaurants, and retail businesses. The Service allows you to create, manage, and share employee schedules using artificial intelligence to optimize shift assignments.

3. Account Registration

To use the Service, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have parental consent
  • Notify us immediately of any unauthorized access

4. Subscription and Payment

ShiftAI offers various subscription plans:

  • Free Trial: Limited features for evaluation purposes.
  • Monthly Subscription: Recurring monthly payment with full features.
  • Lifetime Deal: One-time payment for perpetual access.

All payments are processed through our payment provider (Creem). Refunds are available within 14 days of purchase if you are not satisfied with the Service.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Resell or redistribute the Service without permission
  • Use automated systems to access the Service excessively

6. Intellectual Property

The Service, including its design, features, and content, is owned by ShiftAI and protected by intellectual property laws. You retain ownership of any data you input into the Service. By using the Service, you grant us a license to use your data solely to provide and improve the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for obtaining necessary consents from your employees before inputting their personal data into the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS. AI-GENERATED SCHEDULES ARE SUGGESTIONS AND SHOULD BE REVIEWED BEFORE IMPLEMENTATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIFTAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which ShiftAI operates, without regard to conflict of law principles.
